What if, hypothetically, there was an extremely simple way for ISPs to very clearly and with no ambiguity see that their customers are downloading material which is, beyond any doubt, illegal for them to access?
These cases aren't brought on the premise that ISPs are absolutely liable for the behaviour of their users, but it's on the basis of *secondary* copyright infringement - that is, that they facilitate primary copyright infringement by their users.
so, speed bumps, cameras and fines operate as deterrent and punishment with everyone accepting that there'll never be 100% compliance to speed limits and threatening to close roads or bankrupt their operators won't ever change that
