Problems with an ex-boss

So aside from the fact he still owes me expenses and never paid me overtime he said he would, he never got me a P45 when I left and told me he would but it never materialised. Anyway, I asked the tax office to see what I was due back from not working a full year last year and I had a letter to pretty much say I'd only earned one months salary instead of the six I was there. I told them they must have it wrong so they said ask my old boss to get me a P45 and to write to them even if he couldn't with his name and address.

So, I sent him a message cos that company is closed now (apparently) to ask what address they could write to him just for him to prove to them I worked there for longer and he's refusing to give me an address. Now I've really pushed him for it and he's given me an old address that I'm pretty sure no one lives at anymore, he's obviously avoiding them for a reason but this is just about my own tax nothing to do with him.

STUPID IDIOTHOLE.

    but it will be him/the company who will have had to pay it to HMRC.
    Sounds like he's going to be in a bit of trouble with The Revenue.

      who did work for him, and paying me. But I'm sure he was straight up in terms of tax and what not. Well, it always got taken off my pay anyway!

        Seems like he didn't bother with the second part. Presumably that means that he didn't declare your tax either which is why he can't get you a p45.
        Do you still have all your payslips?

          • Then you can't prove you've paid tax on these earnings.

            If you weren't on payroll you would probably have needed to be invoicing him for the work and then declaring your earnings and paying your own tax.

              • If you were on payroll, he has to give you payslips.

                How long did you work there? Do you have any P60s? They'd prove you were on payroll.

                You probably need to speak to someone other than me as my payroll knowledge is limited and I'm not in any way qualified, but I'd be worried if you have no proof of your paying any tax in his employment.

                Can this new company not just accept a P46? Might be easier and cheaper option. At the same time, ignoring it might be more dangerous in the long run.

                  I don't need the P45 for a new company - I need it for the tax office so they can issue the right taxback I'm owed.

                    Well then I think you have to weigh up whether it's worth trying to claim some tax you have no proof of paying, when you could in fact be putting yourself in a situation where you have to pay a whole load of tax which you actually owe.

    seriously though, if you have reason to believe he's in the tax evasion lark then report him to http://www.direct.gov.uk/en/MoneyTaxAndBenefits/Taxes/ContactOrDealWithHMRC/DG_10010579

    or say to him that you'll report if he doesn't get your shit to you
