because of the way the way the US is set up i still don't thinl he could. there are differences levels of law enforcement, federal and state-level, in the US depending on the circumstances of the offence amd prosecutions also get caught up in this.

I don't think it's a federal decision. Plus I imagine he'd face overwhelming oppisition from the southern states.
Hippy dippy and ultra affluent California are one of the leading states when it ncomes to the death penalty.
TIME magazine put together some maps that show the spread of the US population density, and its spread of different religions, etc.

So, no it's not a simple north/south thing. But the splits between religions (Mainline Protestants/Evangelical Protestants/Roman Catholics) is amazingly stark.
california is really at handing out the death penalty and pretty bad at carrying it out.
