An affront to natural justice, or democracy in action?
Those gayers are better off without it!
"We should have a vote here on Gay marriage and adoption (if we had free speech), i think you would find by the will of the people that they would have too ban them too. but thats never going to happen in this despotic stalinist socially engineered dictatorship!!!!"
Yes, it is that simple. Marriage is between a man and a woman. Nothing in the world can ever change that.
Of course there should also be legal partnerships available for other people if they want to have full life commitment to one another.
Well done you Californians!!!

is the complete mixed message it sends out, given that that gay couples who wed before the election will continue to be married under state law.
I came here to make Arnie jokes.
I've never seen an issue that so clearly has no effect on one side, but could make a big difference to the other. If you pass gay marriage, you're still going to wake up in the morning the same as you did the day before, and if you hate gays, well, they're still going to be be gay regardless of whether they want to shack up, so that's no kind of argument.
It's laughable that in California, the main source of opposition to the law was from the Mormon church, they of family values above all else and polygamy. The issue is about compassion, and as far as I'm concerned, maintaining a ban is no different than the hicks that supported a ban on mixed race marriages in the 20th century.
if you don't like gay sex stop fucking men ?
but then it's probably worth considering that the groups which were prominent in campaigning to have the law reversed aren't just against gay marriage, they're against homosexuality in general. They honestly do feel (not that it is in anyway a justification) that any sort of pervasive homosexuality does affect their quality of life.
that said if a gay dies then their lover is compelled to kill themselves
maybe these freedom haters are just trying to save lives
Plus they are utterly fucked now the 'Governator' has blown all their money and created a humongous budget deficit. He will go down as one of the worst governors in history.
his hands are rather tied by shiftless state Republicans - most of whom can't stand him despite him also ostensibly being Republican - and strict laws limiting property tax rises.
Which means that they rely very heavily on revenue from income taxes, which obviously, in a recession, suffer accordingly.
But you're not wrong about what his historical rep will be when they list their shittiest governors.
Marriage isn't a constitutional right under the US Constitution...therein lies the rub.
An Equal Rights Amendment Bill has consistently failed to pass Congress since the early 1980s, precisely because it would result in any state bans on gay marriage being deemed unconstitutional.
I'm not sure, but I presume certain states will have constitutional provisions for marriage, but for the most part, the federal tier is completely opposed to interfering in what it sees as a state matter. Essentially, any challenge will necessarily depend on the actual state provisions unless, as you say, it is framed in a broad civil rights sort of argument. However, you wouldn't find complete agreement on what constitutes a civil right. What is needed is greater judicial courage (in California) or for someone in Washington to take the lead (unlikely maybe given the divisiveness of the issue).
What I find quite interesting about the California judgement is the dichotomy between a supposed civil right and the principles of democracy. It's like a perfect distillation of tension in the Madisonian democratic system. Obviously, in this case, the judges have sided with the voters when you could argue that they should be more vigilant to protecting the rights of minorities, even if they would need to partake in some judicial creativity to find those rights. We don't really get such conundrums in our (mostly) majoritarian system.

How shameful and disgusting"
