If the guy beating him could be proven to have intended to do GBH, then he could be liable for murder.
'pre meditated' isnt actually part of the law of murder. its 'malice aforethought' which you would think means premeditated, but in actuality it doesnt :)

the original definition of murder is...
the killing of a living human being under the queens peace, with malice aforethought, express or implied.
theres a whole load of case examples and stuff to explain what that actually means, but the mental element of murder just concerns you have to intend to kill, or obliquely intend to kill (which means by doing A, you knew the B was 'virtually certain' to occur, but you did A anyway), or you can be guilty if you intended to do GBH, but the person ends up dying as a result of your actions. (and it gets more complicated after this too)

I found out today that I have to speak for 10 minutes quite academically.
This problem is further extenuated by the fact that I cant control the leakage of swear words that spills out of my mouth.
I asked someone if they were "done with that fucking paper" on the tube today.
i once escalated an already taut discussion about mobile phone music playing with a young man on a bus by accidentally swearing, leading to him threatening to stab me.

I was in harlseden (God-awful place), and these two school kids were threatening to stab each other. It pretty much desecended into primitive shouting and grunting after a while, with no fight starting. As I was moving down the stairs, I heard one voice rise above the cacophony: "Thats it bruv, im gunna stab you right up wiv my fountain pen".
i was in twickenham rather than harlesden, so generally a bit safer

He's a music student and generally has great taste. we listen mingus together and stuff. Thing is, being a music student, he's been trained and everything so only seems to appreciate complex stuff or musically good stuff as apposed to what i would call "interesting" stuff. He doesne't like anything punky or dancey because it's too simple and said Radiohead didn't right good songs and thom yorke couldn't sing. He's a great guy though.
