Can an estate agent delay your arranged moving in date to flat your about to rent?
een some people on here have given good advice about such things before so thought I would give it a whirl.
Situation: Me and my GF were about to move into a new flat together this weekend. We put the holding deposit down a few weeks ago and did all the referencing forms etc and everything was going fine. Then we hear this Wednesday the current Tenant has not been able to move out and they apologised and asked us what would be another convenient date to move in. Well obviously this wasn't on.
I'm starting a brand new job on Monday and moving from where I am now about 60 miles to the new flat. Have arranged help to move, packed stuff up and obviously ended my previous job last week so had this week to sort it out. Basically I need to be living in the location so I can get to work. New Flat is near where my GF lives but she has obviously handed in notice to her current landord and needs to be out this weekend. That’s basically our situation.
Originally the Flat was available on the 1st of March, though that wasn’t good for us so they were fine with arranging to move in this weekend, as it says on the form which we signed when we payed the holding deposit. The currents tennants contract ended this Monday but the 'moving people' let her down or something and she hasn't been able to get out.
Now it just seems we are getting screwed over for other peoples mistakes, we've done everything we need too. The estate agents say they can't throw the current tenant out as they are not legally allowed to go in and touch her belongings.
As it stands best case scenario is she moves out today and we can move in tomorrow afternoon after flat has been professionally cleaned. Worst case scenario they have offered us a flat up the road that we can stay in for a week and then move to the new flat next weekend; which is obviously very shit but better then nothing as we need somewhere to stay!
Just a whole load of stress we don't need added on top of the normal stress of moving. Can't believe they told us 3 days before that we can't move in and we still aren’t finding out if we can move in till the afternoon the day before.
oh, and the flat is in a building that the estate agent manages so we always go through them and don't actually ever deal with the owner/landlord of the flat.
So does anyone even know if they are allowed to do this, what our rights? Etc?
