a couple of months ago I gave our landlord notice saying we were planing to move out september 14th, I just got an email today saying we are being served notice to move out in august, which I literally can't do as I am finishing my msc around then. They also mentioned they wanted to increase the rent, I said would they have to give 2 months notice, they confirmed they would, we didnt hear anything until today when they said as of the 1st june it will be £300 more, can they do this, where do I stand? thanks
Rent thing sounds dodgy.
I'd check your contract carefully and see if it says they have to give notice. If so I'd write to them and tell them you're not prepared to pay increase of rent as is in breach of contract.
The notice to move out I'd say they can do (if the oontract says they have to give you two months notice to move out). Unfortunate but I suspect legally there's little you can do about that.
Do you have a written agreement?
If you have a written agreement, but no documentation stating that the rent was going to go up by £300 a month, they haven't got a leg to stand on. Go to your local advice bureau, they can tell you what your rights are.
sounds like they did give notice
Doesn't notice have to be written though?
I mean to "give notice" you're increasing rent, don't you need to formally say "I'm increasing the rent by this much on x date" rather than just "I might increase the rent by an unspecified amount at a point in the future".
the original post isn't very clear
they said they would be reassessing the rent
but they didnt say by how much until just now and expect it to apply to this month
Depends if it was a verbal notice or a written one
And increase in rent means it has to be written
an*
does an email count
also they once told us all our files including tenancy agreement 'caught fire' does this work in or against my favour?
tell them your rent cheque
caught fire too
Best answer ever.
You really need to vist your advice bureau love
Makes no difference
whether they've got their copy of the contract, as long as you've got yours.
Paid a deposit? Assuming it's one months rent, I'd withold the last month's rent and allow them to take the deposit as payment - you can sort out any deductions they might want to make for damage with them afterwards. If you decide to pay as normal they'll just take the rent increase they want from the deposit.
Though they sound like the type to refuse to pay the deposit back anyway.
Death to landlords
I don't know where you stand, but you have my sympathy.
Speak to CAB.
DiS is not really going to give you the advice you need.
he's not looking for a honk
:D
^Sarcastic grin.
landlords in the g are all scum
my dad used to work in property management around guildford and basically they do what they want.
the dead kennedys have a great song about this.
Assuming you have...
a statutory periodic tenancy (ie, you had a fixed term tenancy which has expired), they have to give you a months notice of a rent increase and they have to do it in a prescribed manner (basically they have to use a form entitled 'Landlord's notice proposing a new rent under an Assured Periodic Tenancy of premises situated in England').
The bad news is that to end the tenancy the landlord does only need to give you 2 months notice. However, they have to serve a valid Section 21 notice on you - an e-mail would not be sufficient.
Having said all this, it's probably best to speak to your landlord or the CAB. Otherwise you may come home to find the locks changed and your clothes on the lawn, regardless of the legal position...
